3. Accessing Our Site

3.1 Credit4 also reserves the right to suspend the service at any time, and gives no guarantee that the Site, or any content on it, will always be available or uninterrupted.

3.2 From time to time, we may restrict access to the Site, or parts of the Site to users who have registered with us.

3.3 You are responsible for making all arrangements necessary for you to have access to our Site. You are also responsible for ensuring that all persons who access our Site through your internet connection are aware of these terms, and that they comply with them.

3.4 We process information about you in accordance with our Privacy Policy. By using our Site, you consent to such processing and you warrant that all data provided by you is accurate.

3.5 We aim to update our Site regularly, and may change the content at any time. If the need arises, we may suspend access to our Site, or close it indefinitely. Any of the material on our Site may be out of date at any given time and we are under no obligation to update such material.

4. Transactions concluded through our site

You acknowledge that no transactions will be concluded through the Site. Any short-term credit facility concluded between you and Credit4 will be governed by different terms and conditions notified to you by Credit4 separately. You acknowledge that only submissions which satisfy the eligibility criteria set out on the Site may be considered by Credit4 and that Credit4 is under no obligation to conclude a credit facility with you.

5. Intellectual Property Rights

5.1 All intellectual property rights in the Site, any trademarks or logos used on the Site, and any content on the Site is, and will remain, the property of Credit4 or its licensors.

5.2 You may print off one copy, and may download extracts, of any page(s) from our Site for your personal reference and you may draw the attention of others within your organisation to material posted on our Site.

5.3 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

5.4 Our status (and that of any identified contributors) as the authors of material on our Site must always be acknowledged.

5.5 You must not use any part of the materials on our Site for commercial purposes without obtaining a licence to do so from us or our licensors.

5.6 If you print off, copy or download any part of our Site in breach of these terms of use, your right to use our Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

6. Our Liability

6.1 You acknowledge that no services are being provided and no facilities or loans will be concluded through the Site, the information provided by you and collected by us through our Site, will be used to check eligibility and to provide us with basic applicant information.

6.2 The use of our Site and the materials contained on it are entirely at your own risk. We shall not be liable for any losses or damages, whether direct or indirect, consequential or otherwise that you may suffer as a result of your use or inability to use our Site. 6.4 Credit4 assumes no responsibility or liability for any third-party links made available through our Site and you use any such links (and/or websites) at your own risk.

6.5 Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

6.6 The Site is provided to you on an “as is” and “as available” basis and all conditions, warranties, representations or other terms which may apply to the Site or any content on it, whether express or implied, are excluded to the extent permitted by law.

6.7 Different limitations and exclusions of liability will apply to liability arising out of any loan transaction between you and Credit4 as set out in the applicable loan terms and conditions notified to you separately by Credit4.

7. Your Liability

7. 1 You shall compensate us in full if we incur any losses or if any claims or legal proceedings are brought or threatened against us by any other person arising from your use of the Credit4 Site.

8. Uploading material to our site

8.1 Any material you upload to our Site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our Site constitutes a violation of their intellectual property rights, or of their right to privacy.

8.2 We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our Site.

8.3 You acknowledge and agree that you are fully responsible for any content that you upload to the Site and agree that you will be responsible for any loss or damage that Credit4 suffers as a result of that content.

8.4 We have the right to remove any material or posting you make on our Site if, in our opinion, such material does not comply with our content standards. You should contact us if you wish to discuss the uploading of material.

9. Viruses, hacking and other offences

9.1 You must not misuse our Site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of service attack.

9.2 By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

9.3 We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any material posted on it, or on any website linked to it.

9.4 We do not guarantee that the Site will be secure or free from bugs or viruses and you will ensure that you have suitable and appropriate software that provides you with the necessary protection.

10.3 You must not establish a link from any website that is not owned by you.

11. Jurisdiction and Applicable Law

11.1 The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our Site.

12. Changes to Terms & Conditions

12.1 We reserve the right to change our terms and conditions periodically as we see fit. We suggest that regularly review our Terms and Conditions. Material changes to our Terms of Use will be notified to you by a specific notice on the Site (which may take the form of a pop-up notification). If you continue to use our Site after such change has been made, you will be deemed to have accepted the amended conditions and the amended Terms of Use will be binding.
